Scopely develops and publishes interactive games for use on web and mobile devices. “Scopely” or “we” or “us” refers to Scopely, Inc. and its subsidiaries, parent companies, joint ventures, and other corporate entities under common ownership and/or any of their agents, consultants, employees, officers, and directors.
EU-U.S. Privacy Shield and U.S.-Swiss Safe Harbor Frameworks
Scopely participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework. Scopely is committed to subjecting all personal data received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. Scopely is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Scopely complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.
With respect to personal data received or transferred pursuant to the Privacy Shield Framework, Scopely is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Scopely may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Scopely collects, processes and retains information about you from four (4) sources: (i) you (i.e., whenever you make personal information available to us); (ii) your devices (including web, mobile and wearable devices); (iii) cookies, web beacons, and other similar technologies; and (iv) social networking sites and gaming partners. The types of information collected may vary depending on the type of activity you are engaged in and the information source.
Personal Information you may voluntarily provide Scopely when you use our Services or register an account with us:
(i) your first and last name, (ii) screen/nick name, (iii) Scopely Services ID or third party service ID, (iv) email address, (v) phone number, (vi) photo or other image, (vii) DOB (month/year), (viii) sex, (ix) address, (x) friend connections, (xi) avatar image, (xii) credit card information, (xiii) shipping information; (xiv) friend’s name and contact information; and (xv) precise geo-location information.
Here are some likely situations when you may make personal information available to Scopely:
(i) registering for our Services and any related contests and special events; (ii) accessing our Services using a third party ID, such as social networking sites or gaming services; (iii) subscribing to newsletters; (iv) purchasing a product or services through Scopely’s online stores; (v) using “tell a friend,” “email this page,” or other similar features; (vi) requesting customer or technical support; (vii) using our Services where personal information is otherwise required for use and/or participation, and (viii) when you provide us with your personal information when applying for a job at Scopely.

Scopely may use analytical software tools to automatically collect and use data that does not directly enable Scopely to identify you. There are two categories of data automatically collected by Scopely: “Website Use Information” and “Device Use Information.”
Website Use Information may include:
(i) IP addresses, (ii) browser type, (iii) Internet service provider (ISP), (iv) referring/exit pages and URLs, (v) operating system version, (vi) date/time stamp, and/or (vii) clickstream data.
Device Use Information may include:
(i) device properties, such as unique device identifier or other device identifier (“UDID”); (ii) device software platform and firmware; (iii) mobile phone carrier; (iv) data about usage of our Services while connected to devices that you authorize us to integrate; (v) geographical data such as zip code, area code and non-precise geolocation; (vi) game score and achievements; (vii) other anonymous or aggregated data as reasonably required by Scopely to enhance our Services and other Scopely related products.
Please note that if you choose to disconnect a device or any Scopely game, we will no longer collect data from that device or game.

You can control the use of certain cookies at the individual browser level. For more information on how you can block, delete, or disable similar technology, please review your browser or device settings. If you reject cookies, you may still use our website and our Services, but your ability to use some features or areas of our website and Services may be limited.
We also use mobile analytics software to allow us to better understand the functionality of our mobile software on your devices. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from.

Single Sign-On: In some instances, you may log in to our website or Services using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate your identity, provide you the option to share certain personal information with us (such as your name and email address, basic profile information, or list of friends), and to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on our website or Services to your profile page to share with others within your network.
How We May Use Your Information

We may also disclose your personal information to third parties when Scopely has a reason to believe that a disclosure is necessary to address potential or actual injury or interference with Scopely’s rights, property, operations, users or others who may be harmed or may suffer loss or damage, or Scopely believes that such disclosure is necessary to protect Scopely’s rights, combat fraud and/or comply with a judicial proceeding, court order, or legal process served on Scopely.

When you use a smart phone or other mobile device to access our Services, with your permission we may collect your geo-location information to optimize user experience, such as for localization accuracy, language display, or the provision of relevant advertising. We will only collect such information if (a) “location services” for the mobile application is enabled; and (b) the permissions in the mobile device allow communication of this information. We will only share this information, such as with third party business partners to provide you with relevant location-based advertising, if we first obtain your express affirmative consent to do so. If you do not want us to collect your location information, you may prohibit the sharing of this information at any time by changing the relevant preferences and permissions in your mobile device.
Upon download of certain Services, you are provided the option to opt in to receiving push notifications from Scopely on your device and within the application. We send you push notifications from time-to-time to (i) inform you of service related messages (e.g., notice that it’s your turn), (ii) communicate messages from buddies and (iii) update you about any events or promotions that we may be running. To ensure you receive proper notifications, we will need to collect certain information about your device such as operating system and user identification information. If you no longer wish to receive these types of communications, you may turn them off at the device level. Opting out of push notifications will not affect your settings with respect to email communications.
E-Mails and Other Electronic Communications
E-mails and other electronic communications Scopely sends to you may contain code that enables Scopely to track your usage of the communication, including whether the communication was opened and/or what links were followed (if any). Scopely may combine that information with other information Scopely has about you and Scopely may use that information to improve our Services and/or provide customized communications to you. Information Accuracy, Access, and Deletion
Scopely does not verify the correctness of your personal information and the accuracy of such information is solely the responsibility of you, the user. However, Scopely makes good faith efforts to enable you to update, confirm, or delete (or otherwise de-identify) your personal information in Scopely’s possession.
Upon request, Scopely will provide you with information about whether we hold any of your personal information. You may access, correct or request deletion of your personal information by:

Scopely will need sufficient information from you establishing your identity in order for us to fulfill your request. Personal information collected by Scopely is stored in secure operating environments that are not available to the public. However, no system can be 100% secure and there is the possibility that despite Scopely’s reasonable efforts, there could be unauthorized access to your personal information. Use by Minors
If you are under the age of 18, you must have your parent’s permission to access the site and our games. If you are under the age of 13, you are not permitted to access the site, use any of our services, or play any of our games. Space Inch develops and publishes social games for the web and mobile devices including “Say the Same Thing” (the “Service”). In this policy, "Space Inch" refers to Space Inch Inc. and its Affiliates, which shall mean subsidiaries, parent companies, joint ventures and other corporate entities under common ownership. We may also refer to Space Inch as "We" or "Us".

Information We Collect
Information about You Received from an SNS
When you use any Space Inch game at or through an SNS such as Facebook or Google +, where our games may also be referred to as “applications”, you allow Space Inch to access certain information from your profile for that site. The information you allow Space Inch to access is affected by the privacy settings you and your friends establish at the SNS. You can control and find out more about these settings at the SNS where you play our games. For example, Space Inch may access and store some or all of the following information, as allowed by you, the SNS and your preferences:
your first and last name
your profile picture or its URL
your user ID number, which is linked to publicly available information such as name and profile photo
the user ID numbers and other public data for your friends
the login e-mail you provided to that SNS when you registered
your physical location and that of your access devices
Information We Collect from You Directly
When you interact with the Service (whether or not through an SNS), at www.Space Inch.com, or any Space Inch-owned website, We may collect and store information from you directly as described below:
We may allow you to “register” with Us by using Facebook Connect or other SNS authentication options to create an account or profile within the Service. We may also provide a more typical registration flow where you may be required to provide the following information: your age or birthday (for age screening and/or to better understand who our users are); your first and last names; your e-mail address; a password and other information that helps Us confirm that it is you accessing your account.
We may also offer you the option to complete a user profile that is visible to other Space Inch users. Your user profile may include: a profile photo; one or more game username(s); your gender; biographic details that you provide; links to your profiles on various SNS; details about the games you play; and a Space Inch user ID number that is created by Space Inch and used to identify your profile.
The Space Inch user ID number used to identify your account and profile will be public and will appear in the URL of your profile page, but will only permit access to information that is considered public or that you have designated as public in your settings.
We may also offer you the ability to import your address book contacts or manually enter e-mail addresses so that you can (i) locate your contacts on Space Inch; and (ii) invite those contacts to join you in our games. We will store those contacts for purposes of helping you and your contacts make connections on our site. Passwords provided to Space Inch for the purpose of accessing your address book will not be stored.
Information We Receive or Collect When You Access Space Inch Games on a Mobile Device
If you play Space Inch games on your mobile telephone or other mobile device, including iPads and tablets, We collect mobile device identifiers, including MAC Address, and IP Address. In certain games We will create and assign to your device an identifier that is similar to an account number. We may collect the name you have associated with your device, device type, telephone number, country, and any other information you choose to provide, such as user name, character name, geo-location or e-mail address. We may also access your contacts to enable you to invite friends to join you in the Service.
If you purchase a license to use in-game virtual currency or virtual items directly from Space Inch, We will collect the billing and financial information necessary to process your charges, which may include your postal and e-mail addresses. Space Inch may also receive the billing and payment information that you provide when your purchase is processed by another party, such as Facebook (for Facebook Credits) or Apple (for purchases on iOS devices). Our Terms of Service explain our policies and terms relevant to our charges and billing practices. Please note that purchases of third party credits or currencies like Facebook Credits may also be subject to additional policies.
Customer Support Correspondence
When you ask for assistance from our Customer Support team, We will collect and store the contact information you provide (generally your name and e-mail address), information about your game play or activity on the Service, and your user ID number. We will also store the correspondence and any information contained within.
SMS Notifications, Push Notifications & Local Notifications
We may send push notifications to your mobile device to provide game updates and other relevant messages. You can manage push notifications from the “options” or “settings” page within the relevant game. You may also be able to manage them from your device’s settings page for the relevant game.

We may collect information about you in any one or more of the following ways:
Information about Players and Play
When you play one of our games, Space Inch collects and stores certain information that you provide directly or through the SNS or other third party website that is offering our game(s). To provide a richer game play and social experience, We also collect information about your play and interaction with other players and the Service. The bulk of this information is collected and stored through the use of Log Files, which are files on our web servers that record actions taken on our games and websites.
You may be able to take part in certain activities on our websites or games that give you the opportunity to communicate or share information not just with Space Inch, but also with other users of our Service. These include:
• participating in player forums and message boards
• posting public comments to other users' profiles or gameboards
• sending private messages or invitations to other users, either directly on our websites or to their e-mail accounts
• chat with other users
• posting photos
We may record and store archives of these communications on Space Inch's servers to protect the safety and well being of our users and Space Inch's rights and property in connection with the service. You acknowledge and consent to the recording and storage of such communications for these purposes.
Cookies and Automated Information Collection
When you access the Service, We collect certain technical information in order to (i) analyze the usage of our sites and services; (ii) provide a more personalized experience; and (iii) manage advertising. We and service providers acting on our behalf, such as Google Analytics, use Log Files and tracking technologies to collect and analyze certain types of technical information, including cookies, IP addresses, device type, device identifiers, browser types, browser language, referring and exit pages, and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, game state and the date and time of activity on our websites or games, and other similar information. One important use of your information is communication. If you have provided your e-mail address to Space Inch, We'll use it to respond to (i) customer support inquiries, and (ii) keep you informed of your in-game activity, including comments from friends, notifications about in-game status as well as notifications. Some messages, such as invites for friends to join you in a game, may include your name and profile photo. We may also send promotional e-mail messages and promotional SMS messages ("Promotional Communications") directly or in partnership with parties other than Space Inch. Each Promotional Communication will generally offer recipients choices about receiving additional messages.

Sharing of Your Information
We will share your information (in some cases personal information) with third parties, that is parties other than Space Inch, in the following circumstances:
Third Party Service Providers
We will provide your information to third party companies to perform services on our behalf, including payment processing, data analysis, e-mail delivery, hosting services, customer service and to assist Us in our marketing efforts. We direct all such third party service providers to maintain the confidentiality of the information disclosed to them and to not use your information for any purpose other than to provide services on Space Inch's behalf.
Friends and Other Space Inch Players
The Service supports and may encourage interaction among players. In most Space Inch games your SNS friends will see your name, profile photo and descriptions of your game activity. In many Space Inch games friends and other players will be able to see your game profile, which may include your name or a “game name” and your profile photo, which in certain cases can reveal your SNS User ID number or Space Inch ID. Access to a Space Inch ID or your SNS User ID may allow others to view the public information associated with your related SNS or Space Inch account. Other players may also be able to send you game requests or even friend requests through the related SNS’ communication channels.
Advertising of Third Party Products and Services
We do not actively share personal information with third party advertisers for their direct marketing purposes unless you give Us your consent.
We may share (i) aggregated information (information about you and other users collectively, but not specifically identifiable to you); (ii) anonymous information; and (iii) certain technical information (including IP Addresses, MAC Addresses for mobile devices and mobile device IDs) to develop and deliver targeted advertising in the Service and on the websites of third parties. We may also allow advertisers to collect these types of information within the Service and they may share it with Us. Advertisers may collect this information through the use of tracking technologies like browser cookies and web beacons. The information collected may be used to offer you targeted ad-selection and delivery in order to personalize your user experience by ensuring that advertisements for products and services you see will appeal to you, a practice known as behavioral advertising, and to undertake web analytics (i.e. to analyze traffic and other end user activity to improve your experience). Space Inch games or their purchase pages may display an "offer wall" that is hosted by an offer wall provider. The offer wall allows third party advertisers to provide virtual currency to users in exchange for interacting with an advertisement or for completing a marketing offer that may include signing up for an account with one of those advertisers. These are not offers made by Space Inch. These offers may be displayed to you based on certain technical information, such as your geographic area or anonymous demographic information. After clicking on one of these advertisements, you will no longer be on a site hosted by Space Inch or a partnering SNS. To properly credit user accounts and to prevent fraud, a unique identifier, in some cases your user ID number, will be shared with the offer wall provider.
Safety, Security and Compliance with Law
Your information, and the contents of all of your online communications (including without limitation chat text, voice communications, IP addresses and your personal information) may be accessed and monitored as necessary to provide the Service and may be disclosed: (i) when We have a good faith belief that We are required to disclose the information in response to legal process (for example, a court order, search warrant or subpoena); (ii) to satisfy any applicable laws or regulations (iii) where We believe that the Service is being used in the commission of a crime, including to report such criminal activity or to exchange information with other companies and organizations for the purposes of fraud protection and credit risk reduction; (iv) when We have a good faith belief that there is an emergency that poses a threat to the health and/or safety of you, another person or the public generally; and (v) in order to protect the rights or property of Space Inch, including to enforce our Terms of Service.
Sale or Merger
In the event that Space Inch undergoes a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, We may transfer all of your information, including personal information, to the successor organization in such transition. If material changes to Space Inch's privacy practices will occur as a result of the business transition, We will notify you and other users (in the manner described in Section 12) of the business transition prior to transferring your personal information.

Information We Receive from Third Party SNS Where You play a Space Inch Game
If you play our games at a third-party SNS, Space Inch will be able to access and store profile and other information about you as described above. The categories of information you share with Us will depend, in part, on the permissions you grant Us and the privacy settings you have established at the SNS where you access the application. Space Inch does not offer an "opt out" option for specific fields that are shared by the SNS where you access and play the game(s).
Opting out of Promotional Communications
